This End User License Agreement ("Agreement") is a legal agreement between you and Tan Buddy ("Licensor") for the Tan Buddymobile application software (the "Licensed Application").
1. Scope of License
Licensor grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Licensed Application on Apple devices that you own or control, strictly in accordance with this Agreement and the App Store Terms of Service.
2. Restrictions
You may not:
- Copy, modify, or create derivative works of the Licensed Application
- Reverse engineer, decompile, or disassemble the Licensed Application, except as permitted by applicable law
- Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application
- Remove or alter any proprietary notices or labels on the Licensed Application
- Use the Licensed Application for any commercial purpose without prior written consent
3. Consent to Use of Data
You agree that Licensor may collect and use technical data and related information — including device type, operating system, and app usage — to facilitate product support, software updates, and service improvement. Licensor may use this information solely in a form that does not personally identify you, except as described in our Privacy Policy.
4. Maintenance and Support
Licensor is solely responsible for providing maintenance and support services for the Licensed Application. Apple has no obligation to furnish any maintenance or support services with respect to the Licensed Application.
5. Warranty
Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Licensed Application.
THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND BEYOND WHAT IS REQUIRED BY APPLICABLE LAW.
6. Product Claims
Licensor, not Apple, is responsible for addressing any claims relating to the Licensed Application, including product liability claims, failure to conform to legal or regulatory requirements, and consumer protection claims.
7. Intellectual Property Rights
In the event of any third-party claim that the Licensed Application or your use infringes a third party's intellectual property rights, Licensor, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
8. Legal Compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms of Agreement
You must comply with applicable third-party terms when using the Licensed Application (e.g., your wireless data service agreement).
11. Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
12. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the Licensed Application and delete all copies from your devices.
13. Governing Law
This Agreement is governed by the laws of the jurisdiction in which Licensor is established, excluding its conflict of law rules.
